A newly expanded database of AI hallucination cases – legal decisions in cases where generative AI (GenAI) hallucinated content – offers fresh insight into this growing crisis. And the numbers are sobering. 

Across hundreds of documented incidents worldwide, a clear pattern emerges. Seasoned attorneys and self-represented litigants are stumbling into the same traps. Courts are escalating their responses. And fabricated citations remain the most dangerous hallucination of all.

Understanding these trends isn't just academic. It's essential for any legal professional navigating the intersection of technology and practice.

The split between lawyers and pro se litigants

As of April 2026, the AI Hallucination Cases Database tracked 1174 court and tribunal decisions worldwide in which judges confronted AI‑generated hallucinations in filings. 

(Clarifying note: The database only counts decisions where a court has actually found or seriously engaged with hallucinated content (most often fabricated case law or misquoted authorities), not every allegation of bad citations or every use of AI in briefs.)

Our review of the database uncovered substantially more self-represented (pro se) litigants appearing in hallucination‑related decisions than licensed attorneys, with the gap even larger when looking only at U.S. cases. That pattern appears to be holding as new decisions are added, even though the absolute counts continue to rise.

It is important to stress what these numbers mean: The database tracks hallucination incidents, not the total universe of court filings. We don’t yet know what percentage of all pro se cases or all lawyer‑handled cases involve AI hallucinations, because there is no reliable denominator for overall filing volume. 

What the data does show, however, is that both groups are regularly appearing in hallucination cases, and self‑represented litigants remain the single largest category in the decisions that have been detected and cataloged so far.

Different users, similar mistakes

The error patterns between these groups reveal both similarities and distinctions.

Pro se litigants

Pro se litigants typically commit more fundamental mistakes, such as citing completely fabricated cases, copying and pasting legal arguments without verification, or misunderstanding basic procedural requirements because they trusted AI suggestions. 

These errors often appear in multiple rounds of amendments, rarely self-correcting before court intervention.

Attorneys

Attorneys, by contrast, tend to experience process breakdowns. They use AI tools to draft filings quickly but fail to verify all cited authorities. Sometimes the errors enter through delegated research — junior staff or paralegals who incorporate fabricated case law without adequate supervision. Other times, attorneys place excessive trust in a platform's reputation, assuming brand credibility equals accuracy.

Both groups share a common vulnerability: confirmation bias amplified by AI behavior. 

Legal professionals often frame questions in ways that signal what they already believe. AI systems, with their tendency to assume the prompt premise is true, can then generate hallucinations that reinforce those beliefs, making false information seem more credible and therefore more likely to be accepted without verification.

The surge in hallucinations points to a deeper issue: Most legal professionals lack a defined methodology for validating AI output or answering the following critical questions:

  • How frequently does a particular chatbot hallucinate?
  • What testing protocols should be applied to measure accuracy rates? 
  • What verification processes must be followed to ensure the information is correct? 

These are critical workflows that legal professionals need, but few have the technical expertise to design from scratch.

Some firms are rising to meet this challenge: forming AI committees, building workflows, tools are being tested, and providing education to attorneys. But these efforts remain inconsistent across the profession.

Overconfidence in technology. As AI tools become more sophisticated, users may assume they're also becoming more reliable. This misplaced confidence leads teams to reduce verification efforts precisely when they should be increasing them.

The verification imperative

The solution is straightforward but requires discipline: every citation generated by AI must be verified against trusted legal research platforms before filing.

This verification can't be cursory. Legal teams need to confirm that:

  • The case actually exists in the relevant jurisdiction
  • The citation accurately represents the holding
  • The case remains good law and hasn't been overturned or distinguished
  • Quoted passages match the original source exactly

The Judicial Orders database maintained by EDRM reveals how differently judges are handling AI issues across jurisdictions. Some courts require disclosure of AI use in all filings. Others impose disclosure only when errors come to light. Sanctions vary widely in severity and type.

In Gauthier v. Goodyear, for example, the court went beyond monetary sanctions. The judge required the attorney to personally inform the client about the sanctions order — meaning the client became directly aware that their lawyer had cited hallucinated cases. This type of consequence extends beyond financial penalties to reputational and relationship damage.

The challenge is clear. Each judge continues to deal with AI issues differently, even as consequences escalate. 

This must change. We need overarching rules to govern AI usage disclosure and errors. ABA Formal Opinion 512 is a good start, but we need stricter guidelines from the Federal Rules.

The current patchwork of standards will likely persist until federal rules or professional standards bodies establish clearer guidance. Until then, legal teams must adopt the most rigorous standards as their baseline, ensuring their practices would satisfy even the strictest jurisdictions.

Building a verification culture

Preventing AI hallucinations requires more than individual diligence; it demands institutional commitment to verification at every stage of the legal workflow.

Practical steps for legal teams to build a verification culture

Establish clear AI use policies. Teams need written guidelines that specify when AI tools can be used, what verification steps are mandatory, and who is responsible for accuracy. These policies should be reviewed and updated regularly as technology and judicial standards evolve.

Create verification checklists. Every AI-generated citation should trigger a mandatory checklist: Does this case exist? Is it from the correct jurisdiction? Does the quoted language match the source? Is it still good law? Checklists prevent shortcuts under deadline pressure.

Document AI involvement. Maintain clear records of which tools were used, by whom, and when. This documentation can protect teams if questions arise later since it demonstrates good-faith efforts to use AI responsibly.

Train continuously. AI literacy can't be a one-time orientation. As tools evolve and new risks emerge, legal professionals need ongoing education about capabilities, limitations, and best practices. Many firms now include AI use in their regular CLE programming.

✅ Stay current with evolving standards. Ethical rules and court requirements regarding AI use are changing rapidly. Regular monitoring of developments — through bar associations, legal publications, and professional networks — is essential.

✅ Invest in training. Whether through formal CLE programs, in-house education, or partnerships with technology providers, legal teams need ongoing development in AI literacy. The goal isn't to turn lawyers into technologists, but to ensure they understand both the capabilities and the limitations of the tools they're using.

✅ For pro se litigants: proceed with extreme caution. Self-represented parties using free or public AI tools to draft filings face very real risks. Sanctions apply even to non-lawyers in serious cases. When possible, consult with an attorney before filing AI-generated content, and always verify any legal citations independently.

The technology provider's role

AI vendors bear responsibility too. The most ethical approach to legal AI isn't maximizing automation. It's maximizing verifiability.

Technology providers should focus on:

  • Building systems that significantly reduce or eliminate hallucinations through better training data and model architecture
  • Creating transparent workflows where users can easily trace AI outputs back to source material

They're the ones who learn to wield AI tools with appropriate skepticism, capturing the efficiency gains while maintaining the verification rigor that the profession has always demanded.

To find that balance, think about how your team will validate AI outputs. Then rigorously follow those validation steps, because the consequences of not following them are real: damaged reputations, failed cases, monetary sanctions, and professional discipline. And so are the opportunities.
