Hold Product Terms
1. Scope
This document provides supplemental information and terms that apply to DISCO’s Hold Technology Offering, which is a centralized hosted platform for managing preservation compliance (the “Hold Offering”). All capitalized terms used but not otherwise defined herein will have the meanings given to such terms in DISCO’s Terms and Conditions as well as the Order governing Customer’s use of the Hold Offering.
2. Product Tiers
The Hold Offering is offered in the following product tiers:
Hold Basic: DISCO Hold Basic includes one Domain; access to the Hold Offering; reporting and logs.
Hold Professional: DISCO Hold Professional includes one Domain and all functionality and features included in DISCO Hold Basic, but also includes Office365 Active and Google Directories; and single sign-on (SSO).
Hold Enterprise Unlimited: DISCO Hold Enterprise Unlimited includes one Domain and all functionality and features included in DISCO Hold Professional, but also includes human resources information systems (HRIS) integration; asset hold integration; and in-place preservation (IPP). Hold Enterprise also includes 100 GB of DISCO Collect.
Hold Enterprise Limited (Small): DISCO Hold Enterprise Limited (Small) includes one Domain and all functionality and features included in DISCO Hold Professional, but also includes human resources information systems (HRIS) integration; asset hold integration; and in-place preservation (IPP). Limited to 20 active holds.
Hold Enterprise Limited (Medium): DISCO Hold Enterprise Limited (Medium) includes one Domain and all functionality and features included in DISCO Hold Professional, but also includes human resources information systems (HRIS) integration; asset hold integration; and in-place preservation (IPP). Limited to 100 active holds.
Integrations; Custom Requests. Integrations included in each package are limited to those currently offered by DISCO. DISCO reserves the right to modify, replace or discontinue any integrations. Requests for custom integrations, configurations, dashboards, reports or other technologies or features beyond the standard offerings will be evaluated on a case by case basis. Such requests will incur additional fees and will require a separate statement of work outlining scope and cost. DISCO shall retain all right, title and interest in and to any custom work, including all Intellectual Property Rights related thereto.
Additional Domains. Customer may add additional unique IP addresses that are registered with a defined name and extension (“Domains”) for an additional fee.
3. Authorized Use Metrics
One-time setup. One time charge to set up a Hold Offering environment inclusive of integrations with applicable systems. Set up includes validations of system sync, connections, and the migration of existing matters and/or requests. Training for admins and users also included as part of setup and implementation of the Hold Instance.
Active Hold: An Open Matter in the Hold Offering.
Instance: The Hold Offering platform with administrative control over the company’s legal holds. Separate instances would be necessary if Customer needs separation of data access, etc. because of jurisdiction (e.g. US v. EMEA v. APAC) or functional separation of a company entity.
Domain: The source tenant that the Hold Offering connects to (e.g. M365 or Google Workspace). Subdomains would not be considered separate domains.
